BUYER:

The natural person who registers on the Site and places an order ('Buyer'). The Buyer's identity, address and contact details are as declared in the order form.

ARTICLE 2 — SUBJECT

This Distance Sales Agreement ('Agreement') governs the rights and obligations of the parties regarding the sale and delivery of products ordered by the Buyer through www.barofe.com, within the framework of Turkish Law No. 6502 on the Protection of Consumers and the Distance Contracts Regulation.

ARTICLE 3 — PRODUCTS SUBJECT TO THE AGREEMENT

The order summary (product name, quantity, unit price, total amount, VAT information) is communicated to the Buyer on the order completion screen and in the confirmation email. Product specifications, prices and stock information are as applicable at the time of ordering.

The Agreement is concluded at the moment the Buyer clicks the “Complete Order” or “Proceed to Payment” button. Confirmation of the conclusion of the Agreement is sent to the Buyer via the order confirmation email.

ARTICLE 4 — PAYMENT INFORMATION

The Buyer can complete their order via credit card, debit card or other supported payment methods through Shopify Payments, Stripe or Iyzico infrastructure. Payment is collected at the time of ordering.

All payment transactions are secured with SSL/TLS encryption. Card details are not stored on BÂROFE's servers.

ARTICLE 5 — DELIVERY

• The delivery period is 5–10 business days for domestic (Turkey) orders and 7–21 business days for international orders, from the confirmation of payment.
• The delivery address is the address specified by the Buyer in the order form. BÂROFE cannot be held responsible for delays arising from incorrect or incomplete address information.
• Shipping fees are determined based on the order amount and delivery country and are shown in the order summary.
• Free shipping may apply for orders above a certain amount. Campaign conditions are announced on the Site.
• For international orders, customs duties and import charges are the Buyer's responsibility.

ARTICLE 6 — RIGHT OF WITHDRAWAL

Products offered for sale by BÂROFE are prepared in accordance with customers’ requests and are produced on a made-to-order basis. Accordingly, these products fall within the exception to the right of withdrawal under Article 15 of the Distance Contracts Regulation, titled “Exceptions to the Right of Withdrawal”, as goods prepared in accordance with the consumer’s requests or personal needs.

Within this scope, the right of withdrawal cannot be exercised and returns are not accepted. Our company’s liability is limited solely to defects arising from production.

However, a one-time size or model exchange may be requested within 7 days of the delivery date. Exchange conditions are set out in detail in the Return & Exchange Policy.

Situations where the right of withdrawal cannot be used (pursuant to Article 15 of Law No. 6502):

• Products prepared in accordance with the Buyer's request or clearly personal needs,
• Products whose price is dependent on fluctuations in financial markets,
• Products whose packaging has been opened after delivery and which are not suitable for return on grounds of hygiene or health,
• Underwear and swimwear products (on hygiene grounds).

ARTICLE 7 — PRODUCT WARRANTY AND DEFECTS

If the delivered product is defective (damaged, incorrect or incomplete), the Buyer may exercise one of the following rights: replacement of the product, a price reduction, or withdrawal from the contract. Defect notification must be made within 2 (two) years of delivery.

ARTICLE 8 — DISPUTE RESOLUTION

Complaints should first be submitted to info@barofe.com. For unresolved disputes:

• Consumer Arbitration Committee (within statutory monetary limits)
• Consumer Courts
• Ministry of Trade e-Government Complaint Portal: www.e-devlet.gov.tr

ARTICLE 9 — GOVERNING LAW

This Agreement is governed by the laws of the Republic of Turkey, Turkish Law No. 6502 on the Protection of Consumers and the Distance Contracts Regulation.
