Article 1 — Parties

Buyer
The person placing an order through www.barofe.com. The Buyer's name, surname, address, and contact details are as provided during checkout; the Buyer is responsible for their accuracy.
Article 2 — Subject
This Agreement governs the sale, delivery, and exchange of products ordered through the site, as well as the rights and obligations of both parties arising from that relationship. It enters into force upon order completion and payment confirmation.
Article 3 — Products
The name, main specifications, size, colour, quantity, unit price, applicable taxes, shipping fee, and grand total of the ordered products are presented in detail at the checkout summary and in the Order Confirmation email. Every BÂROFE piece is crafted exclusively on a made-to-order basis, in accordance with the individual customer's request.
Article 4 — Payment & Invoice
All payments are processed through Shopify Payments, Stripe, or İyzico under SSL/TLS encryption. Card data is not stored in BÂROFE's systems; payment information is handled in PCI-DSS compliant environments. If the payment provider does not authorise the transaction, BÂROFE is under no obligation to fulfil the order.
An invoice is issued electronically as an e-invoice or e-archive invoice and delivered to the Buyer digitally, or included with the shipment, depending on the Buyer's jurisdiction and preference.
Article 5 — Delivery
Orders are prepared and dispatched within the following estimated timeframes:
- Domestic (Turkey): 5–14 business days from order confirmation
- International: 7–21 business days from order confirmation
These are estimates. BÂROFE accepts no responsibility for delays arising from the made-to-order production process, courier workload, customs processing, or force majeure events. Delivery is made to the address provided at checkout; any complications resulting from incomplete or incorrect address information are the Buyer's responsibility. All customs duties and import charges on international orders are borne by the Buyer.
Article 6 — Formation of the Agreement
An order request is generated when the Buyer completes the checkout steps and clicks "Confirm Payment." The Agreement becomes legally binding upon the Buyer's receipt of an "Order Confirmation" email; it is finalised upon subsequent receipt of a "Shipping Confirmation" email. If no Shipping Confirmation is issued, the Agreement is deemed not to have been concluded.
BÂROFE reserves the right to partially or fully cancel orders in cases of technical errors, stock shortages, obvious pricing errors, or security concerns. In such cases, any amount charged will be refunded in full.
Article 7 — Inability to Deliver
If the Buyer is absent at the delivery address or fails to collect the product from the courier branch within the notified period, the product may be returned to BÂROFE. In such cases, BÂROFE may terminate the Agreement and refund the amount paid, deducting any return shipping costs incurred.
Article 8 — Transfer of Risk and Ownership
The risk of loss or damage passes to the Buyer at the moment of delivery to the Buyer or to a third party authorised by the Buyer. Ownership of the product transfers to the Buyer upon physical delivery and full payment of the purchase price.
Article 9 — Right of Withdrawal & Returns
Every piece at BÂROFE is made for you, and only after your order is placed. As such, our products fall within the withdrawal exception set out in Article 15 of the Distance Contracts Regulation:
"The right of withdrawal cannot be exercised in contracts relating to goods prepared in accordance with the consumer's requests or personal needs." (Art. 15/1-ç)
Accordingly, returns are not accepted. The Company's liability is limited strictly to defects of production origin. Notwithstanding the above, a one-time size or model exchange may be requested within 7 (seven) days of delivery. The full conditions governing this right are set out in the Return & Exchange Policy.
Article 10 — Defective Products
Should the delivered product contain a defect of production origin, the Buyer may elect one of the following remedies under Article 11 of Law No. 6502:
- Replacement with a non-defective equivalent
- A proportional reduction in the purchase price
- Free repair
- Rescission of the contract
BÂROFE will inspect the returned product and inform the Buyer of the outcome. If the defect is confirmed as production-related, all costs including shipping will be borne by BÂROFE. These rights must be exercised within 2 (two) years of the delivery date.
Article 11 — Protection of Personal Data
The Buyer's personal data is processed in accordance with Turkish Law No. 6698 on the Protection of Personal Data (KVKK) and the EU General Data Protection Regulation (GDPR), solely for the purposes of fulfilling orders, providing customer service, and meeting legal obligations. Article 12 — Buyer's Declarations and Acknowledgements
By confirming the order, the Buyer acknowledges and agrees to the following:
- Having read and understood the Pre-Information Form, this Agreement, the Privacy Policy, and all site terms and conditions;
- Having been informed in advance of the essential characteristics of the ordered products, the total price, and the payment obligation;
- That the right of withdrawal does not apply, that returns are not accepted, and that only the 7-day exchange right is available.
Article 13 — Buyer Default
Should the Buyer default on a credit card payment, any interest or charges imposed by the issuing bank are solely the Buyer's responsibility; BÂROFE bears no liability in respect of such obligations.
Article 14 — Dispute Resolution
Any complaints arising from this Agreement must first be submitted in writing to info@barofe.com. If the matter cannot be resolved between the parties, Consumer Arbitration Committees shall have jurisdiction within the statutory monetary thresholds set out in Law No. 6502; Consumer Courts shall have jurisdiction for amounts exceeding those thresholds.
Article 15 — Governing Law
This Agreement is governed by and construed in accordance with the laws of the Republic of Türkiye.
Article 16 — Force Majeure
Neither party shall be held liable for failure to perform its obligations due to circumstances beyond its reasonable control that could not have been foreseen, including but not limited to natural disasters, pandemics, war, government actions, strikes, or infrastructure outages. Should such circumstances persist for more than 30 (thirty) consecutive days, either party may terminate the Agreement without any liability for damages.
APPENDIX — SAMPLE WITHDRAWAL FORM
(To be completed only if exercising the right of withdrawal. Please note that our products are made to order and are as a rule exempt from the right of withdrawal; this form applies only in exceptional circumstances.)
